This is not a Baffour case – Senyo Hosi identifies key actors in SIC investigation

Political commentator Senyo Hosi says the investigation involving Manhyia South MP Nana Agyei Baffour Awuah should focus on the institutions and their decision-makers rather than centring on the lawyer involved in the SIC settlement.

Hosi questioned why Baffour Awuah had become the main focus when SIC Life and Equity Savings and Loans were the parties involved in the transaction.

“Let’s stop talking about this as if it’s a Baffour case. It’s not a Baffour case,” he said.

Hosi argued that a lawyer’s role is to represent a client and act on the instructions given, while the authority to make decisions rests with the client and its leadership.

“Balfour cannot enter a contract in his own capacity as a lawyer for his clients. He can only represent his clients in a contract if he signs for the client under the authority of the client,” he said on TV3 Keypoints.

He identified the directors of SIC Life and Equity as the people whose decisions and actions should be examined.

“There are two key actors. Who are the directors of SIC Life? Who are the directors of Equity? That’s where the conversation should be. Not the lawyers representing either of them,” he said.

Hosi also raised questions about the sale of land that SIC had reportedly exercised a charge over, asking how Equity could proceed with the transaction.

“How did Equity sell a land that SIC had exercised charge over? That is a fundamental problem,” he said.

He further questioned who approved the transaction and who failed to stop it or have it reversed.

Co-panelist Edudzi Tamakloe’s contributions formed part of the discussion about the roles of the lawyers and the parties involved. Hosi maintained that the central issue was the responsibility of the institutions and the people who had authority over their decisions.

He said focusing on the lawyers could distract from the wider questions surrounding the transaction and the alleged loss to the state.
