Influencer Ashley St Clair has filed a paternity suit against tech giant Elon Musk, seeking sole custody of her five-month-old son. Musk has not publicly acknowledged the child. The petitions were filed in Manhattan Supreme Court on Friday.
St Clair is asking the court to establish Musk as the child’s father. She is also seeking a court order for Musk to take a genetic test to confirm paternity, the New York Post reported. According to her filings, the child was conceived during a trip to St Barths in January 2024.
In a separate custody petition, St Clair stated that Musk was not present for the birth and had met the child three times, twice in Manhattan and once in Texas. She also alleged that Musk had not asked to see the child or requested photos.
Court filings include a photograph of St Clair holding an infant and messages purportedly exchanged between her and the Tesla CEO. In one message, after St Clair sent a photo of herself and the newborn, a contact saved in her phone as “EM” replied, “All well?”
St Clair responded, “He is perfect.” The reply from “EM” read, “I look forward to seeing you and him this weekend... Falling asleep. Hope the recovery goes well.”
In another message, “EM” wrote, “I want to knock you up again,” after St Clair sent him a picture of herself. When she raised concerns about communication, he replied, “Hmm ok... Well, I do have a legion of kids to make.”
St Clair said she left the father’s name blank on the birth certificate due to safety concerns, citing Musk’s claim that he receives “credible death threats every day.”
Ashley and Musk had been commenting on each other's posts, but he had not directly addressed the controversy.
Earlier, the SpaceX CEO responded to a social media post that accused Claire of planning for years to "ensnare" him. His response was a single word: "whoa."
Claire, in response to Musk engaging with the speculation, wrote, "Elon, we have been trying to communicate for the past several days, and you have not responded. When are you going to reply to us instead of publicly responding to smears from an individual who just posted photos of me in underwear at 15 years old?"
