9-Jugde bench of Supreme Court holds, all private properties cannot form part of ‘material resources of the community’

New Delhi: The nine-Jugde bench of Supreme Court held that all private properties cannot form part of ‘material resources of the community’ on Tuesday.

According to reports, a nine-judge bench of Supreme Court while delivering a verdict on the question whether a State can take over private properties to distribute to subserve common good, held all private properties are not material resources and hence cannot be taken over by states.

Supreme Court by the majority verdict ruled that all private properties cannot form part of the ‘material resources of the community’ under Article 39(b) of the Constitution and can’t taken over by State authorities to subserve the “common good”.

A nine-judge Supreme Court bench was presided by Chief Justice of India D Y Chandrachud and also comprised of Justices Hrishikesh Roy, J B Pardiwala, B V Nagarathna, Manoj Misra, Sudhanshu Dhulia, Satish Chandra Sharma, Rajesh Bindal, and Augustine George Masih.
