CJP leaders Dipke, Ranka, Das under preventive arrest, to be produced before magistrate today

New Delhi: Cockroach Janata Party (CJP) leaders Abhijeet Dipke, Saurav Das and Ashutosh Ranka were placed under “preventive arrest” after being detained at Delhi’s Indira Gandhi International Airport on Saturday (October 10). The Delhi Police said the trio would be produced before an executive magistrate at Delhi Cantonment Police Station on Sunday (October 11).

They had travelled from Mumbai to Delhi to join a planned protest at Jantar Mantar demanding the resignation of Chief Election Commissioner Gyanesh Kumar over alleged irregularities in electoral rolls during the Special Intensive Revision (SIR).

The three were detained shortly after their flight landed on Saturday morning. Delhi Police personnel took them away from the airport and held them at separate police stations. They were kept in custody for 24 hours under preventive detention provisions, police officials said.

Members of the CJP’s legal team are expected to be present when the leaders are produced before the magistrate and released, sources said.

Police cite BNSS provisions

A police officer told The Indian Express that the arrests were made to prevent a possible disturbance to public order. The action was taken under Sections 126 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).

Section 126 allows a magistrate to require a person to execute a bond to maintain peace. Section 170 empowers police to make preventive arrests when they believe an offence may be committed and immediate action is necessary. The corresponding provisions under the old Code of Criminal Procedure (CrPC) were Sections 107 and 151.

The police said the three leaders would be produced before an executive magistrate on Sunday morning. Their release was expected after the required procedure at the Delhi Cantonment police station.

Protest denied permission at Jantar Mantar

Dipke, Ranka and Das had planned to stage a sit-in at Jantar Mantar on Saturday to demand Gyanesh Kumar’s resignation. The Delhi Police had denied permission for the demonstration, citing prohibitory orders imposed under Section 163 of the BNSS in the New Delhi area.

The police action extended beyond the three CJP leaders. The Delhi Police said around 7,000 people were detained on Saturday after allegedly attempting to march towards Jantar Mantar. The police also reported injuries to some personnel during efforts to control the crowds.

Security was tightened across Central Delhi, with around 30,000 police personnel deployed and multiple layers of barricades set up at several points. Restrictions were imposed as groups attempted to reach the protest site.

The CJP has called for another protest march and demonstration at Jantar Mantar on Sunday at 10 am. The planned gathering follows Saturday’s detentions and the police refusal to permit the original demonstration.
