Salomey Awiti: If you hold someone beyond 48 hours, the court should take it seriously – Barker-Vormawor

Barker-Vormawor said a person accused of an offence should not lose constitutional protections simply because a criminal investigation is ongoing.
He questioned the circumstances surrounding Bafoh’s detention and argued that the courts should be vigilant when suspects are kept in custody beyond the period allowed by law.
“If a judge receives a suspect who has been held beyond 48 hours, I would discharge that person and arrest the officer for contempt,” Barker-Vormawor said on JoyNews’ Newsfile.
He said courts have a responsibility to protect constitutional rights rather than treating alleged violations as secondary issues in criminal proceedings.
According to him, the courts should not consider violations of suspects’ rights as unnecessary matters when determining how a case should proceed.
Barker-Vormawor also stressed that his concerns about Bafoh’s detention should not be interpreted as support for the statements or material at the centre of the case.
His comments form part of a wider argument that law enforcement must balance criminal investigations with due process and constitutional protections.
