Four days after a high-speed incident on VIP Road, Kanpur Police arrested Shivam Mishra, the 35-year-old son of tobacco tycoon K.K. Mishra. This arrest marks a significant breakthrough in a case that has sparked public outrage, accusations of police protection, and a failed attempt to blame a family chauffeur.
The arrest and charges
DCP (Central) Atul Srivastava confirmed that police took Shivam into custody after they learned he had returned to Kanpur.
Current status: Shivam will appear in front of a local court shortly.
The accusation: Initially, the FIR was filed against an "unknown driver." It now directly names Shivam Mishra under the Bharatiya Nyaya Sanhita (BNS) for reckless driving, threatening lives, and causing injury through dangerous means.
The failed 'driver swap' drama
In a key legal development just 24 hours before the arrest, the Additional Chief Judicial Magistrate (ACJM-VII) dismissed a surrender application from Mohan Lal, a 45-year-old man.
The claim: Mohan Lal, who drives for the Mishra family, claimed in court that he was driving the ₹10-crore Lamborghini Revuelto.
Court verdict: The court rejected the plea, stating that Mohan’s name had never come up in the police investigation.
Victim's u-turn: The complainant, e-rickshaw driver Mohd Tausif, reportedly filed a "settlement" plea naming Mohan as the driver. However, the court decided that the state's evidence was more important.
CCTV evidence vs. 'medical emergency'
While the Mishra family and their lawyer, Narendra Kumar Yadav, argue that Shivam had a seizure while riding as a passenger, police evidence tells another story:
Viral footage: Several videos show private bouncers breaking the car’s window and pulling Shivam Mishra out from the driver’s seat.
GPS tracking: Digital records confirm Shivam was at the scene during the crash.
Eyewitnesses: More than 10 witnesses have said that the car was speeding before it struck Tausif’s rickshaw and a motorcycle.
Action against 'negligent' cops
The case has led to disciplinary measures within the Kanpur Police. Gwaltoli SHO Santosh Gaur has been removed for "procedural lapses."
Allegations: Reports claim the SHO helped arrange an unauthorised "settlement" between the victim and the family at the station on the day of the crash.
The shielding row: Public anger grew after images showed the seized Lamborghini being covered inside the police station, allegedly to conceal its identity from the media.
The Mishra legacy under scrutiny
The crash has renewed interest in the Mishra family's business, Banshidhar Tobacco Group. In March 2024, the family faced extensive income tax raids across 20 locations, resulting in the seizure of luxury cars—including a Rolls-Royce and a McLaren—and ₹11 crore in cash.
