Sharmistha Panoli Granted Interim Bail by Calcutta High Court After Arrest Over Controversial Video

by · TFIPOST.com

The Calcutta High Court has granted interim bail to 22-year-old law student and influencer Sharmistha Panoli, who was arrested last week for allegedly posting a controversial video on social media.

Panoli, who hails from Pune, was taken into custody by Kolkata Police from Gurugram after her video — reportedly related to ‘Operation Sindoor’ — was accused of hurting religious sentiments and promoting disharmony. Though she later deleted the clip and issued a public apology, the video had already gone viral, triggering backlash and a police case under various sections of the Indian Penal Code.

Health Concerns and Legal Appeal

Panoli’s legal team appealed for bail citing her medical condition, particularly a kidney ailment that requires ongoing care. Her lawyers also raised concerns about the conditions she was held in, noting limited access to reading material and difficulties in managing her health during custody.

The court, acknowledging these concerns, granted her interim bail and directed authorities to ensure her continued cooperation with the investigation.

Freedom of Speech or Provocation?

The case has reignited the national debate on the boundaries of free speech and responsible online behavior. While some legal experts argue that Panoli’s arrest was excessive and infringes on personal freedoms, others believe that her content crossed the line by potentially inciting communal discord.

Support and Backlash

Actress Rupali Ganguly publicly criticized the West Bengal Police for the arrest, calling it a violation of civil liberties. She urged the National Human Rights Commission and National Commission for Women to intervene, especially in light of Panoli’s reported treatment in custody.

At the same time, many on social media supported the police action, emphasizing the need to curb divisive content, especially in a sensitive sociopolitical climate.

Panoli’s case remains under legal scrutiny, and the court has not yet issued a final verdict. However, her release on interim bail offers temporary relief while the investigation continues.

The incident has underscored the delicate balance between digital expression and social responsibility, and how courts and law enforcement may navigate similar cases in the age of viral content.
