The Madras High Court, on May 12, had restrained Sethupathi, who won the Tamil Nadu Assembly elections from Tiruppattur district by one vote, from voting or taking part in the floor test of the legislative assembly.

The plea was mentioned for urgent hearing before Chief Justice of India (CJI) Surya Kant by senior advocate Abhishek Manu Singhvi earlier on Tuesday, following which the apex court agreed to list the matter for hearing on Wednesday.

The Supreme Court also stayed the proceeding pending before the Madras High Court in the matter.

A single postal ballot, an 18-vote discrepancy and a one-vote victory have triggered a political and legal storm in Tamil Nadu, with the Madras High Court stepping in over fears the disputed mandate could influence the government’s fate.
