Kerala High Court grants bail to Rahul Mamkootathil MLA in sexual assault case
The Kerala High Court has granted anticipatory bail to the Palakkad MLA in the first of three alleged sexual assault cases filed against him, effectively securing protection from arrest in all current matters. While the court observed that the allegations did not prima facie establish a case of rape, it imposed several strict conditions for the bail. The MLA is prohibited from leaving Kerala and must surrender both his passport and mobile phone to the investigating officers. Additionally, he is strictly barred from contacting the complainant or influencing any witnesses. The court has also mandated that he appear before the investigation officers every second Saturday. This legal development provides significant relief to the legislator ahead of the upcoming assembly elections, as it allows him to remain on the ground. However, the court maintained that if an arrest is required, he must be released on bail immediately under the specified conditions, ensuring the investigation continues without his detention.
